The Supreme Court issued Opinion to Convict Roe v. pick up calf

The Supreme Court issued an opinion that Roe v. Wade would overturn the landmark decision giving women a constitutionally protected right to an abortion, a report said.

The draft majority opinion was written by Judge Samuel Alito and made available to Politico.

“Roe was terribly wrong from the start,” Alito writes in the 98-page draft statement available to the outlet.

The conservative-controlled Supreme Court has overturned the 1973 decision guaranteeing constitutional protections for abortion rights, as well as the subsequent 1992 decision by Planned Parenthood v. Casey.

“We believe that Roe and Casey must be overridden,” he writes in the document, dubbed the Opinion of the Court.

“It’s time to heed the constitution and return the issue of abortion to the elected representatives of the people.”

The draft decision, written in February, would end federal protections against abortion and instead give each state the choice to limit or ban abortion.

It’s not clear if there were subsequent changes to the design, Politico reported.

According to the outlet, no draft decision in the court’s modern history has been publicly released, while a final decision on one case is pending.

SCOUTS judges have been known to change their votes as opinions circulate, Politico noted, and important decisions like this can go through multiple drafts before a final decision is made.

A source familiar with the court’s discussions on the matter told the outlet that four of the other Conservative justices – Clarence Thomas, Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett – joined Alito in his vote after the judges had been convened in December after oral negotiations.

The four judges have maintained their positions as of this week. The source said Democrat-appointed Justices Stephen Breyer, Sonia Sotomayor and Elena Kagan were working on one or more dissenting opinions, leaving Justice John Roberts – who is expected to either join the dissenting opinion or draft his own opinion .

The right to an abortion up to around the 23rd or 24th week has been protected since the Roe v. Wade federally protected by the Constitution 49 years ago.

In December, the Supreme Court signaled its willingness to overturn the landmark case and allow Mississippi to ban abortion after 15 weeks.

If passed, the Alito bill would rule in Mississippi’s favour—which, according to the Guttmacher Institute, an abortion rights research group, would prompt about 26 Southern and Midwestern states to outright ban abortion.
