Gutierrez died Monday after a car hit him.
At the time, he was doing off-duty work as a motorcycle escort.
Gutierrez was taken by LifeFlight to Memorial Hermann Hospital in critical condition, where he was pronounced dead.
The driver, Lavilia Spry, 40, allegedly fled the scene after hitting Gutierrez. She was then stopped by another deputy and arrested.

Sheriff Ed Gonzalez said she showed signs of being intoxicated.
Spry was charged with manslaughter with drunken assault, failure to contain and aid in connection with death, and evasion of arrest. During Monday’s hearing, a judge set her bond amount at $275,000 on three counts.
The defense argued for a lower bond, arguing that Spry had just given birth to a baby four weeks ago and that she was the caretaker of that child and a 15-year-old. But the judge disagreed, saying she did not appear to be overly concerned about her child’s well-being as she was arrested at nearly 1:30 a.m. while allegedly intoxicated.

Gutierrez served in the sheriff’s office for 20 years. Among them, he has spent the past 13 years with the Vehicle Crime Division.
According to Gonzalez, Gutierrez is married to his high school sweetheart and they have three children together – including a daughter who will get married in a few months.
Friends of Gutierrez in the HCSO told Eyewitness News that because of the wedding the sergeant was taking on extra work, like an escort, which he was performing at the time of his death.
