NYC needs to check if there was an error returning Julissia Batties to mother Adams

Mayor Eric Adams said Thursday the city must investigate “whether” the Children’s Services Administration abandoned little Julissia Batties – who was allegedly murdered by her mother shortly after she was returned to her care.

The mayor has been asked to respond to the girl’s grieving father’s claims that “the system has failed her” – referring to ACS’s decision to return Julissia, 7, to her mother Navasia Jones, less than two months before she was found beaten to death in August 2021.

“We really need to check if there was a bug,” Adams said at an independent news conference.

“Every time we have cases like this, we’re always analyzing how we could do something better,” he continued, “and so I don’t know if I support what the father says about it.”

The slain girl’s father, Julius Batties, shot back that the mayor had to “do his homework.”

“It’s all black and white,” Batties told the Post. “Go and look at the recordings and then come back to me.

“You all work for the city and ACS is run by the city,” he said. “It’s a shame for the city and even worse for the mayor to say that. He should do his homework before he speaks and assess the situation if he doesn’t know what he’s talking about.”

The tragic boy has been the subject of a heated custody battle for most of her life. Her paternal grandmother, Yolanda Davis, was granted temporary custody of Julissia after her birth.

Jones – who was charged with murder and manslaughter on Wednesday – had lost custody of the girl along with their four sons at birth over alleged negligence and physical abuse.

In a heartbreaking audio recording from The Post, young Julissia cried hysterically and begged her grandmother not to send her on a court-ordered weekend visit to her mother’s.

There was a known history of violence at the home, with police being called to NYCHA’s Mitchel Houses apartment at least six times between May 2018 and March 2020 over alleged abuse of the girl, sources said.

Despite her pleas, Julissia was sent to live with her mother, and over the objections of her grandmother and a court-appointed attorney, ACS moved her there permanently that spring.

The child’s lifeless, battered body, with trauma evident everywhere, was discovered just months later.

Prosecutors alleged Wednesday that the girl’s 18-year-old half-brother, Paul Fine, Jr., physically and sexually assaulted her between August 8 and the day of her death, August 10, and that her mother did nothing to get it their help. He was charged with sexual assault, murder and manslaughter.

Both Jones and Fine Jr. were held without bail pending their arraignment.

Julissia’s grandmother said Thursday that ACS “saw the red flag and ignored it.”

“The kid told them and they didn’t listen. How can you allow a child to go back to where they were abused?” Davis asked.

“I’m really hurt,” she added. “I went to the cemetery today. I told her, ‘I’m still fighting for you and I’m not going to stop.’ ”

When asked for comment, including whether an investigation into the case had been opened, City Hall referred the Post to the mayor’s earlier statement and to the ACS.

An ACS spokesman said Thursday that the agency is barred by law from commenting on details of specific cases.

“We have been closely reviewing this case to do everything possible to ensure the safety of the children and the support of the families,” the spokesman said in an email.

But a city police officer said ACS hadn’t done enough.

“Obviously the system failed with this little girl,” said former councilman Stephen Levin, chairman of the corporation’s General Welfare Committee. “She should never have been in a home with that brother.

“Without knowing the details, it’s hard to see where the inflection decisions were made,” Levin added. “But it’s important that ACS as an agency … do a review of what happened.

“This little girl’s future was stolen from her,” he said. “It’s just heartbreaking.”

At a news conference late Wednesday, Bronx District Attorney Darcel Clark said it took 10 months to make an arrest in the case because her office wanted to be diligent.

“The coroner will not rush,” Clark said. “It takes time for them to follow up on what leads them to medical evidence, things like that.

“So we didn’t want to rush anything,” she said. “As we’ve seen things, they take more time to do more testing and gather more evidence. It just took time. It took as long as it took.”

The autopsy revealed Julissia was sodomized as she lay dying after suffering fatal beatings during the horrific beating, authorities said.

She had 600 millimeters of blood in her abdomen, according to the autopsy.

Adams also defended the delay in the arrests on Thursday.

“It’s always important,” he said. “You never want to rush a case without all the evidence… It has to be done right.”
