A upstate judge on Friday dismissed Donald Trump’s lawsuit to halt New York Attorney General Letitia James’ investigation – which he has described as a “witch hunt.”
The former president filed the lawsuit in Syracuse federal court in December, saying the AG’s two-year investigation into the Trump Organization’s business dealings was being conducted with “political animus” because James viewed Trump “as a political opponent.”
Trump asked federal court to drop a lawsuit in Manhattan Superior Court that James has brought against Trump and the company, alleging they are blocking their investigation. Or alternatively, Trump demanded that James be forced to withdraw from both her civil case and her participation in the Manhattan District Attorney’s criminal investigation.
Syracuse Federal Judge Brenda Sannes denied those motions by dismissing Trump’s lawsuit, noting that he could have made the same motion by the Manhattan judge handling James’ lawsuit.
“The court concludes that the plaintiffs could have asserted the claims and sought relief in the federal lawsuit in the New York trial,” Sannes said in the decision.
“Time and time again, the courts have made it clear that Donald J. Trump’s baseless legal challenges cannot stop our lawful investigation into his financial dealings and those of the Trump Organization,” James said in a statement Friday. “No one in this country can choose how the law applies to them, and Donald Trump is no exception.”
Trump’s attorney, Alina Habba, said, “There is no question that we will appeal this decision.”
James’ office launched its investigation in 2019 after Trump’s former attorney, Michael Cohen, testified before Congress that Trump had inflated company assets for insurance, credit and tax purposes.
AG then filed a lawsuit in Manhattan Supreme Court in 2020, claiming the company was blocking the investigation.
