KENDALL Jenner’s 818 tequila company is being CONTRACTED by a rival brand for copying its name and logo.
The 26-year-old is in the midst of a legal battle with competing company Tequila 512.
TMZ reports that Tequila 512 claims 818 copied its name using the area code for the nickname.
Kendall’s brand 818 is a nod to the San Fernando Valley area code, while 512 pays homage to Austin.
In addition, in the lawsuit, Tequila 512 claims that the colors on the bottles of the two brands are very similar.
The company alleges that the similar colors are intended to confuse consumers when purchasing Aluminum’s trademark Keeping Up With the Kardashians.
Tequila 512 argues that they were copied, as they have been selling tequila since 2015.
Meanwhile, Kendall set up her company in 2021.
The lawsuit also targets Kendall’s sister Kim Kardashian, 41.
In the lawsuit, the company claims its 512 bottle of Tequila is centered in an ad promoting 818 on the Kim Kardashian: Hollywood app.
It is not clear at this time whether the inclusion of Tequila 512 in the application was intentional, although the mistake may underline how similar the bottles are.
The company argued in the lawsuit: “Either Defendant knowingly used Plaintiff’s bottle, hoping to further blur the line between the two products, or Defendant himself was confused about the distinction between the two trademarks. “
Kendall was not named as a defendant in the case, as it was only the company being sued.
A company representative said: “We are reviewing the complaint and believe the allegations are baseless.”
The Tequila 512 is hoping to have a judge stop manufacturing and selling the 818.
In addition, the company wants to profit from the sale of 818 tequila.
The incident happened a few months later Tequila 512 has criticized Kendall for allegedly copying their brand.
Back in May 2021, Tequila 512 launched Kendall on Instagram with a striking image showing a message from a confused customer asking about the same things.
There’s just a rectangular yellow backing plate behind the branding to make the words float on the transparent glass – in similarly shaped bottles.
In the footnote, Tequila 512 makes even more of an impression on 818, pointing out that the KUWTK star uses the exact same agave farm and distillery they use in Jalisco, Mexico.
They wrote: “You may have seen that @kendalljenner released a ‘new’ tequila today.
“Note the similarities, including the color, the name, and it’s made in the same Mexican tequila distillery as ours.
“Their batches are being double-distilled. Ours three times. However, she is charging double for each bottle.
“And here we get the same messages as in this post image. Doesn’t seem very good. What do you think?”
According to reports, tequila is required to be distilled twice to a minimum but higher quality brands, such as 512, complete the process a third time.
Tequila 512 retails for about $30 a bottle depending on where it was purchased, while 818 will cost almost $60 – if not more.
In a statement to The Sun, 512 CEO Nick Matzorkis questioned how “sensible” it was for Kendall to research and visit other distilleries in the Jalisco region of Mexico to produce her tequila, but did not come across a brand that has “existed” for 8 years and unanimously won Best in Show at prestigious spirit competitions around the world. “
