Harris County Sheriff Ed Gonzalez identified Francisco Javier Lupian, 32, as the uncle of the boy who owns an unattended gun from Monday’s shooting.

The sheriff’s office said Lupian was visiting his family at the home on Guston Hall Lane in west Harris County when the shooting occurred. Family members took the child victim to the Hermann Katy Memorial, where he was then flown to a hospital at Texas Medical Center.
In a bail application, Lupian is accused of leaving an unsecured firearm.
“The defendant’s 9-year-old nephew pulled the bolt back and pointed the gun at his 4-year-old brother, hitting him in the head,” the document reads.
The application filing went on to mention that Lupian taught the 9-year-old how to use a specific feature on his gun.
“The defendant had previously shown the 9-year-old how to pull the bolt on the firearm,” the document said.
Lupian, who is accused of possession of a firearm by a convicted felon, is scheduled to appear before a probable cause hearing on Tuesday afternoon.
Lupian’s previous charges include a 2012 crime committed in Colorado County for which he was convicted and sentenced to three years in prison.
The four-year-old is now in critical condition.
The shooting marks another alleged moment a child had access to a firearm. As of April 2021, 13 investigations counted 67 cases in Harris County since a Texas law went into effect in 1995.
An analysis of 13 investigations also showed that adults rarely serve time, even after being found guilty.
