Harris County Precinct 4’s Constable Office will re-establish more than 100 previously filed criminal cases

Herman said his agency has launched a new initiative to reopen criminal cases brought by Harris County criminal court judges. Herman said judges had expected hundreds of cases for dismissal, citing a lack of probable cause.
“I’ve been in touch with 64 other law enforcement leaders here in Harris County. I’ve encouraged them to find resources and do exactly what I’m doing here in Precinct 4. We just can’t let it go. these people go without a date for them to go to court,” said. Herman. “We’re seeing more and more crime. We’re on the verge of total collapse here in Harris County with public safety in mind if we don’t change course. I’m choosing instead. change course. I feel confident that other law enforcement leaders will do the same.”
Over the past three weeks, it’s investigated more than 100 cases, Herman said. Leaders with two law enforcement unions joined Herman at his announcement. Officials affiliated with the unions have urged the public to vote on all current judges of the criminal court in Harris County, citing public safety concerns.
Steve Shellist, a defense attorney in Greater Houston, called Herman’s actions unusual, saying they could further clog an already congested criminal justice system. He said police officers should stick to the facts and not try to reintroduce troubling incidents.
“I’m not just talking about the defendants. I’m talking about the victims. If the police think he’s going to go out and be ‘best friends’ with the district attorney and try to bring in a bunch more cases in system, many of which are probably misdemeanor cases, to further clog the system. It will only hurt other victims and other defendants who have been waiting for justice for a long time. .”
Herman said it was his duty to hold elected judges accountable for their decisions.
