The reporter who “Sh—y media guys,‘, a table detailing allegations of harassment and sexual assault against 70 journalists, may face a libel trial after a federal judge denied their request for immunity.
Moira Donegan, 32, was sued for defamation in 2018 by Stephen Elliott, a New Orleans-based writer whose name appeared in the online document. Elliott is seeking $1.5 million in damages from Donegan and other list creators, alleging defamation and emotional distress.
“Because the defendant failed to meet her burden as to whether she expressly encouraged illegal content, her motion must be denied,” US District Court Judge LaShann DeArcy Hall said in court filings Thursday.
Roberta Kaplan, Donegan’s attorney, sought Donegan’s immunity under the Communications Decency Act, a controversial law that protects social media users who repost or host information from being held legally responsible for what others do online to become.
Although Donegan was behind the creation of the chart, according to court documents, she encouraged other women to contribute with their own allegations of inappropriateness against men in the media.
