Supreme Court Justice Neil Gorsuch has confirmed that the Supreme Court’s internal investigation into the unprecedented leak of a draft opinion in the case overturning Roe v Wade is underway – and that he expects a report soon.
“The chief justice has established an internal committee to oversee the investigation,” Gorsuch said Thursday at a conference in Colorado for judges and attorneys at the 10th Circuit Court of Appeals, according to the Wall Street Journal.
“This committee has been very busy and we look forward to their report, hopefully soon,” he added.
Gorsuch did not specify whether the findings of the investigation would be made public.
Gorsuch, like other judges, has said he believes Judge Samuel Alito’s draft opinion in Dobbs v. Jackson Women’s Health Organization was released to influence the court to uphold its 1973 decision that made abortion rights statewide was implemented.
“Improper efforts to influence judicial decision-making, from any quarter, are a threat [to the judicial process]’ Gorsuch said, adding that disclosure could reduce the openness of communication between judges ahead of decisions.
“I really hope that sooner or later we’ll get to the bottom of this,” the judge continued.
Chief Justice John Roberts ordered an investigation into the leak shortly after Politico released the draft, but the court was curious about the progress of the investigation.
Gorsuch’s comment in Colorado is the first public comment by a sitting judge on the investigation.
The Dobbs court’s decision — overturning Roe and returning the abortion rights issue to each of the 50 states — was issued June 24. The majority opinion – written by Alito and who sided with Gorsuch – was nearly identical to the leaked draft.
