A Pennsylvania statewide court has awarded a massive victory for election integrity as the 2022 midterm elections continue to draw near.
Based on WPMT-TVa Commonwealth Court filing released Friday shows the court found a provision allowing Pennsylvanians to vote by mail without cause in violation of the Pennsylvania constitution.
Known as Act 77, the law was first passed in 2019. According to WPMT, Republicans initially supported the bill as a compromise with Democrats.
Pennsylvania Republican Party member wants to remove the option of straight ticket voting, allowing people to vote for every candidate of a particular party with just one mark at the top of the ballot.
Democrats largely support straight voting, so the state’s Republicans need to make their own concessions to get enough support for the bill. As a result, they added a provision in Act 77 that would allow universal suffrage by mail, WPMT reported.
As the coronavirus pandemic shakes the nation in 2020, it also highlights the many possibilities of shortfalls in systems around the country. Those difficulties include not only the incompetence of many parts of the Department of Health and Human Services, but also concerns about elections.
The 2020 election saw an unprecedented number of mail-in ballots across the US, and Pennsylvania is no exception. More than a third of all votes cast in the state are done by mail, WPMT reported.
With this increase, the question of the integrity of vote by mail. As more mail-in ballots become available, the potential for fraud in this voting method becomes much more apparent.
Mail-in ballots are not inherently fraudulent, but they can be rigged in a variety of ways. Unlike in-person ballots, these ballots are often left unattended by an election officer as they are cast, which increases the potential for fraud.

Republicans realized in the 2020 election that they made a mistake. There’s a reason why Pennsylvania’s constitution only allows mail-in ballots from those eligible to vote absenteeism.
Of course, the media wants to paint Republicans as hypocrites for going against a bill they previously supported. Recommended WPMT Pennsylvania Republicans were “disappointed with voting by mail after then-President Donald Trump began baselessly attacking it for rife with fraud during the 2020 campaign.”
Democratic Governor Tom Wolf made a similar argument and said he would appeal the court’s ruling.
“The Republican-controlled Legislature passed Proposition 77 with strong bipartisan support in 2019 to make voting safer, more secure, and accessible to millions of Pennsylvanians. accepted it,” he said in a statement.
“The simple fact is that while Republicans almost unanimously support the legislature for this historic update to Pennsylvania election law, they now want to eliminate voting by mail in favor of ‘big lie’.”
However, it is possible that Republicans in the state are simply learning from experience. After an election filled with voting by mail, they realized the amount of concern such voting methods could cause.
Also, new Republican concerns about voting by mail didn’t just surface after the defeat election. Instead, they are rooted in the Pennsylvania constitution itself.
According to WPMT, Article VII, Section 1 of the Pennsylvania constitution, voting must be conducted in person unless the eligible voter casts an absentee ballot. To amend the constitution, the voters of Pennsylvania would have to pass the bill.
Judge Mary Hannah Leavitt, President of the Commonwealth Court, said if such an amendment were brought before voters, it would likely be approved.
“[A] According to the WPMT, constitutional amendments must be presented to the people and passed into our basic law, Leavitt writes, before a law allowing no-reason voting by mail can be ‘put into the statute book’. ours,’ Leavitt wrote, according to WPMT.
No matter what decision Pennsylvania Republicans make in 2019, the simple truth is that popular voting by mail presents an unnecessary opportunity for fraud. Elections in Pennsylvania will be more sure after this decision.
