Kenneth Wayne Wesley, 39, is charged with aggravated assault on a child.
“His statement is that his son fell to the ground, which was a two to three foot fall, but the injuries are inconsistent,” said Gilbert Sawtelle, the prosecutor in the case. “They are more consistent with violent acceleration and deceleration forces or concussions and also with a blunt force injury to his head or multiple blunt force injuries to his head.”
The child was taken to Texas Children’s Hospital by ambulance on March 31.
“While he was in the hospital when he realized what the injuries were and that a detective was coming to question him, he set off on foot and ran almost a mile inside the medical center before he was caught.” said Sawtelle. “You can take that however you want, but I think that’s a pretty good indication of some level of guilt.”
Court records show doctors diagnosed the child with bleeding in the brain and eyes, multiple skull fractures, and new and healing broken ribs. The child died on March 4th. Prosecutors said the child spent the last month of his life in his father’s care because the child’s mother is in prison for her third DWI.
During Saturday’s probable court hearing, Wesley spoke several times and maintained his innocence.
“I didn’t hurt my son,” Wesley told the judge, despite being told not to speak by the public defender. “He fell. I can’t stand anyone saying anything about my son.”
The 39-year-old appeared visibly distressed during the court. He was unhappy with the $500,000 bond.
In court, Wesley told the judge, “I don’t have $500,000. I have no money. I say so. That bond, I’m not even going to be able to make that bond so I can come out and do things to help myself in this situation.”
Both the defense attorney and the prosecutor made the decision not to address the bail bond during Wednesday’s court hearing. Wesley has a blue warrant, meaning he’s been charged with another crime while on probation. He was found guilty of sexually assaulting a 13-year-old and sentenced to 12 years.
Based on the autopsy results, Sawtelle said Wesley’s charges were upgraded to either felony murder or capital murder.
