A Bronx man caught on video brutally beating a motorist with what appear to be brass knuckles after a car crash has been charged with only misdemeanor charges and released under new bail laws, the Post has learned.
Miquiel Guerrero, 23, was released on his own six days after he and five friends allegedly conspired against a 53-year-old driver — with Guerrero hitting the victim multiple times in the head and body with the metal object, according to a spokeswoman for the bureau confirmed by the Bronx District Attorney.
Guerrero was arrested for robbery over the March 30 incident in the Concourse neighborhood but was charged on April 5 with three misdemeanors and one injury, according to the criminal complaint against him.
New York State bail reform banned cash bail for most misdemeanor and nonviolent crimes. The defendant eventually faced charges of assault, threats and possession of weapons, as the ad showed.
The prosecutor’s office did not explain the decision as to why Guerrero did not face the higher charge.
Guerrero was the driver of a Lexus SUV that collided with a Kia van and both vehicles crashed into an unoccupied parked Honda sedan on Exterior Street at 6:40 p.m. on March 30, police officers said.
A shocking video showed Guerrero and five others swarming the Kia – with one of the crew climbing onto the car to stomp on it.
Guerrero can be seen in the video repeatedly punching the 53-year-old man who was driving the Kia. Guerrero used a metal object “wrapped around his ankles,” the complaint said, but did not specify whether the object was brass knuckles or another weapon.
The outnumbered victim ran for cover when two of the men stole his van and drove away, police officers said at the time. Three others jumped into the Honda and fled, police said. Guerrero stayed at the scene and was arrested.
The victim had stitches above his eye and had “swelling of his back, nose, face and left eye,” the complaint said.
The NYPD released video of the confrontation asking the public for help identifying the other men. The incident is still under investigation, the prosecutor said.
