WASHINGTON (WNCN/AP) — President Joe Biden has released a statement, following a leaked Supreme Court draft, indicating that Roe v. Wade would be crushed.
In a statement released a day after Politico released a draft opinion suggesting the Supreme Court might be ready to overturn the ruling, Biden said he could not speak to the authenticity of the draft, saying, his government is preparing for all eventualities when the final court rules.
Biden said a decision to oust Roe would raise the stakes for voters in November’s heated midterm election.

“We do not know if this draft is genuine or if it reflects the court’s final decision.
With that critical caveat, I want to clarify three points about the Supreme Court cases.
First, my government argued strongly in court in defense of Roe v. Calf. We said that Roe is based on “a long body of precedent recognizing the 14th Amendment concept of personal liberty…against government interference in deeply personal choices.” I believe a woman’s right to vote is fundamental, Roe has been the law of the country for nearly fifty years, and the fundamental fairness and stability of our law demands that it not be repealed.
Second, shortly after the passage of Texas SB 8 and other laws restricting women’s reproductive rights, I directed my Gender Policy Council and the White House Office to prepare options for a government response to the ongoing assault on abortion and reproductive rights on possible outcomes in the cases pending before the Supreme Court. We will be ready when a verdict is made.
Third, if the court overthrows Roe, it will fall to our nation’s elected officials at all levels of government to protect a woman’s right to choose. And it will fall to voters to elect pro-choice officials in November. At the federal level, we will need more pro-choice senators and a pro-choice majority in the House of Representatives to pass legislation codifying Roe, which I will work to get passed and signed into law.”
Whatever the outcome, the Politico report late Monday represents an extremely rare case Violation of the court’s secret deliberative procedureand in one case of paramount importance.
“Roe was grossly mistaken from the start,” says the draft report. It was signed by Judge Samuel Alito, a member of the court’s conservative 6-3 majority appointed by former President George W. Bush.
The document was named “1. Draft” of the Opinion of the Court in a case challenging Mississippi’s 15-week abortion ban, a case known as Dobbs v. Jackson Women’s Health Organization.
The court is expected to rule on the case before his term ends in late June or early July.
The draft opinion states that there is no constitutional right to abortion services and would allow individual states to regulate the procedure more tightly or ban it outright.
“We believe that Roe and Casey need to be overridden,” it said, referring to Planned Parenthood v. Casey in 1992, which upheld Roe’s finding of a constitutional right to abortion services but allowed states to impose some restrictions on this practice. “It’s time to heed the constitution and return the issue of abortion to the elected representatives of the people.”
A Supreme Court spokeswoman said the court had not commented and The Associated Press could not immediately confirm the authenticity of Politico’s published draft, which dates from February.
