Apple files an appeal against a ban on selling iPhones without a charger in Brazil

SAO PAULO – Apple on Tuesday said it would appeal a Brazilian injunction banning it from selling iPhones without a battery charger, dismissing claims that the company is offering consumers an incomplete product.

The Justice Department fined Apple $2.38 million and ordered the company to cancel sales of the iPhone 12 and later models and suspend sales of all iPhone models without a charger.

In the decision, published in the country’s official gazette on Tuesday, the ministry argued that the iPhone lacked a key component of a “deliberate discriminatory practice by consumers.”

Authorities dismissed Apple’s argument that the practice was designed to reduce carbon emissions, saying there was no evidence that selling the phone without a charger offered environmental benefits.

Apple said it will continue to work with Brazil’s consumer protection agency Senacon to “address their concerns” and said it would appeal the decision.

“We have already won several court rulings in Brazil on this matter and are confident that our customers are aware of the different ways to charge and connect their devices,” Apple said.

The order comes a day before Apple is expected to announce its new iPhone model.
