Under the rules of professional conduct of the state’s Unified Court System, attorneys can be disfellowshipped for a wide range of noncriminal misconduct, including anything that “adversely reflects” their “fitness to practice law.”

Cuomo’s 48-page letter to the First Department of Justice prosecutors’ appeals committee repeated many of the same arguments made by his defense attorney Rita Glavin during a series of press conferences following his August 10, 2021 resignation.

But he also picked up on an exclusive front-page report in The Post last year that revealed how a state police bodyguard allegedly spotted then-governor and his top aide Melissa DeRosa as they were “walking like high school kids on the making out sidewalk”.

Cuomo accused James of intentionally including “seditious hearsay” testimonies despite “knowing she had direct conflicting information and choosing not to release it.”

“Once AG James released that portion of the transcript and the media then seized it, AG James was obligated to tell the public that other soldiers contradicted the story,” he wrote.

“By not doing so, she has misled the public and committed wrongdoing.”

Glavin’s lengthy virtual presentations — each lasting up to two hours and live-streamed on Cuomo’s campaign website — were part of a multi-pronged strategy to rehabilitate his battered image as he flirted with a potential political comeback.

Cuomo has posted photos on social media showing him fishing with one of his few remaining friends – his dog Captain – and celebrating his 64th birthday at a tiny party with his youngest daughter and two guests captured via cell phone video from afar were present.

Although some polls indicated that the former second-generation Democratic governor could pose a threat to his successor – Governor Kathy Hochul, who is up against Republican challenger Lee Zeldin for a full term – Cuomo ultimately remained on the sidelines of the election.

But he recently spent $60,000 on Facebook ads to promote a column by libertarian Cato Institute colleague Cathy Young that was published late last month.

In it, Young said a review of public records and an exclusive interview with Cuomo led her to believe that his “resignation, like that of Sen. Al Franken in 2017, may be viewed more as a case of #MeToo excesses than a success.” could become.”

Cuomo claimed that the attorneys — former acting US Attorney for Manhattan Joon Kim and Anne Clark, an expert on workplace discrimination — displayed “bias” and misled the public with a 168-page report that said: “the intentional omission of evidence contradicting allegations of sexual harassment and undermining witnesses and the applicant’s credibility.”

In a prepared statement, the AG’s office said, “Attorney General James, Joon Kim and Anne Clark adhere to the highest ethical standards.”

“Mr. Cuomo resigned after an independent investigation found he had exploited several women who worked for him. New Yorkers stand ready to move forward and close this sordid chapter in our state’s history,” the statement added added.
